These Terms & Conditions govern your access to and use of the Hemant Fresh website and the purchase of products from us. By browsing this site, creating an account or placing an order, you agree to these terms. If you do not agree, please do not use the site.

1. About us

Hemant Fresh is a fresh-fruit business based in Maharashtra, India, selling fresh fruit and fruit packs to customers across India through this website. All prices are listed in Indian Rupees (₹/INR) and are inclusive of applicable taxes unless stated otherwise.

2. Products, availability & pricing

Our products are fresh, seasonal and perishable. Availability, weight, size and appearance can vary with the harvest, and an item may sell out or go out of season at short notice. We make every effort to display products, prices and descriptions accurately, but errors can occur — if we discover an error in the price or description of an item you have ordered, we will contact you before dispatch and you may confirm or cancel that order. Prices may change at any time, but changes do not affect orders we have already confirmed.

3. Orders & acceptance

When you place an order you are making an offer to buy. Your order is confirmed only when we accept it and assign it an order number. We may decline or cancel an order — including for reasons of stock, suspected fraud, a pricing error, or an address we cannot service — and where you have already paid for a cancelled order, we will refund you in full (see our Cancellation & Refund Policy).

4. Payment

We currently accept Cash on Delivery. A secure online payment gateway (cards, UPI, net banking and wallets) is being added; all online payments will be processed by a PCI-DSS-compliant third-party payment gateway over an encrypted connection, and we never see or store your full card or banking credentials.

5. Delivery

We deliver through a temperature-controlled cold chain. Delivery areas, timelines and charges are set out in our Shipping & Delivery Policy, which forms part of these terms.

6. Perishable goods, cancellation & refunds

Because our products are perishable, specific cancellation and refund rules apply. Please read our Cancellation & Refund Policy, which explains when you can cancel, your eligibility for a refund or replacement, and how refunds are made.

7. Your account

You are responsible for keeping your account details and password confidential and for all activity under your account. Please give accurate, current contact and delivery information so we can fulfil your order — we are not liable for a failed delivery caused by an incorrect address or unavailable recipient.

8. Acceptable use & intellectual property

You agree not to misuse the site, attempt to disrupt it, or use it for any unlawful purpose. All content on this site — text, images, branding and design — belongs to Hemant Fresh or its licensors and may not be copied or reused without our written permission.

9. Limitation of liability

To the extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms limits any rights you have under applicable consumer law.

10. Governing law

These terms are governed by the laws of India, and the courts at Satara, Maharashtra shall have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights available to you.
